The Vice President, Commercial Management will provide strategic leadership and oversight of commercial decision-making for parts of the GO Expansion program being delivered by the Capital Projects Group; coordinated commercial leadership across the corporation; and, in situations where executive involvement is warranted, provides commercial advice to the President and CEO, SMT, and other Metrolinx leaders.

What will I be doing?

• Under the guidance of the Executive Vice President, Commercial, lead the development and deployment of a commercial management strategy within the business unit and across the corporation for assigned parts of the GO Expansion Program.
• Champion and lead the commercial management function within the assigned parts of the GO Expansion Program, throughout the lifecycle of all material contracts / projects, and ensure there are effective and efficient policies, procedures, and best practices in place to establish and maintain that function.
• Provide leadership, organize the establishment of major departments and oversight of material commercial decisions within the assigned parts of the GO Expansion program, at all stages in the project and contract lifecycle (including contract development, execution, and amendment), to ensure sound and consistent commercial decision-making.
• Establish objectives for the company and in collaboration with the Chief Legal Officer and their leadership team provide guidance/support on Metrolinx’s and the business unit’s existing contract obligations.
• Represent the company and be held accountable for the resolution of issues of significant corporate significance, as required to recover or protect Metrolinx’s commercial reputation, and ensure value for money and sound commercial decision-making.
• Effectively deal with significant commercial issues, including complex engineering and operational challenges to ensure the completion of key projects and strategies; facilitate collaboration and cooperation between stakeholders and external vendors to ensure project delivery and issues resolution.
• Coordinate the work of regions, divisions, or departments.
• Champion the Commercial Management model, interactions and governance of the delivery, shared support, central support, and enterprise teams to ensure value for money and strong commercial decision-making.

What Skills and Qualifications Do I Need?

• Completion of a university degree in Engineering, Business Administration, Management or a related discipline is required.
• Minimum 15 years experience in progressively senior project leadership roles; experience leading large complex projects from conception to build with experience and measured success in the application of commercial management methodology in the context of multi-million-dollar projects; experience in the transportation industry and public sector is a requirement.
• Strong expertise in contract formation, drafting, and negotiation, particularly with FIDIC, JCT, AS, and bespoke contract forms (EPC, lump sum, re-measurable, target cost) in PMC, EPCM, and PPP environments.
• Heavy Rail Transit experience is preferred, including expert knowledge of transit-related construction, engineering and/or operations.
• Expert knowledge of procurement structures, principles, methodologies, and practices, including progressive contracts and Alliance models, P3 or Alternative Financing and Procurement (AFP) procurement methodologies.
• Expertise in construction law, claims management, dispute resolution, and negotiation
• Expert knowledge of the stage gate design and delivery process for major projects, to effectively lead and manage projects through the project lifecycle.
• Expert knowledge of construction contract administration, actual cost management, target pricing and claims management techniques and practices in a large multi project complex transit construction and infrastructure environment.
• Previous experience leading high profile/multi-million-dollar projects.
• Broad knowledge of municipal, provincial, and federal regulations and best practices applicable to transit, including as related to workplace safety.
• Proven experience in providing strategic advice to government entities and ministers on major infrastructure projects, including best practices in business cases, commercial and management structures, procurement processes, and project execution and delivery.
• Strategic thinking, and strong decision-making and analytical abilities, as required to identify/resolve complex/high profile commercial and contract management issues.
• Sound judgement and problem-solving skills to effectively apply broad functional policies/principles (including business, legal, technical, and operational) to identify and resolve commercial and contract management issues and reach commercial sound resolutions.
